CHEAP LAS VEGAS DIVORCE - Do I Need to Pay Child Support?

"My spouse and I are getting a divorce and we have children together. We both agree that no child support should be paid. Can we do that?"

This is a question that we get from both fathers and mothers alike who come into our Las Vegas paralegal divorce office or call us on the phone.

Most parents who are getting a divorce in Las Vegas and who have kids and who are dealing with us to get a cheap divorce in Las Vegas are able to agree or compromise on virtually all of the BIG issues.

So it doesn't surprise us when they agree to a child support amount or they come to a decision that because both parents will have physical custody of their minor child(ren) about 50/50 that they agree that no child support payment should be made to either parent.

The Las Vegas courthouse has guidelines for how child support should be calculated for parents with minor child(ren) who are separating or getting a divorce. (in fact these guidelines are virtually the same across the whole state of Nevada)


For your convenience, we have put a table below that will help you figure out approximately how much child support would be owed:

How Child Support is Typically Calculated in Many Cases:
  1. For primary physical custody — where ONE parent has custody of the minor child(ren) over 60% of the year (219+ days)
    1. 1 child – 0.18% of gross monthly income of the other parent.
    2. 2 children - 0.25% of gross monthly income of the other parent.
    3. 3 children - 0.29% of gross monthly income of the other parent.
    4. Each additional child - 0.02% of gross monthly income of the other parent.

  2. For joint physical custody – where EACH parent has custody of the minor child(ren) for at least 40% of the year (146 days at minimum)
    1. 1 child - 0.18% of gross monthly income of the each parent.
    2. 2 children - 0.25% of gross monthly income of the each parent.
    3. 3 children - 0.29% of gross monthly income of the each parent.
    4. Each additional child - 0.02% of gross monthly income of the each parent.
    5. You will then subtract the amount each parent is obligated to pay for child support and the parent who makes the most money shall pay the difference in this amount to the other parent.
Like everything, there are exceptions to the rule. The state minimum guideline for child support is $100/mo. per child.

You can also petition that the court deviate from the mandated amount because of other factors (such as travel time, health insurance costs, medical expenses, etc.)

So long story short is that you can petition the court and ASK that no child support is made to either party, but that is totally up to the judge's discretion whether they accept that or not.
